第37卷第1期2023年2月保险职业学院学报(双月刊)JOUＲNALOFINSUＲANCEPＲOFESSIONALCOLLEGE(Bimonthly)Vol.37No.1Feb．2023雇主责任保险纠纷审理的困境与突破＊———以277件司法案件为样本程潇淑(上海市黄浦区人民法院，上海200000)［摘要］雇主责任保险是用人单位用于转嫁企业用工风险，维护和保障企业正常经营活动的一种责任保险。本文通过分析雇主责任保险案件审理中常见的争议点，确立审理此类案件要始终坚持财产保险的损失补偿原则，充分补偿被保险人的实际损失，以平衡保险人与被保险人合法利益，实现保险产品分散风险的设计初衷;同时为防止被保险人攫取超额收益，从源头上减少纠纷的发生，需要保险公司优化管理制度和条款设计，用工企业增强法律意识，监管主体加强协作化解纠纷。［关键词］雇主责任保险;免责条款;工伤保险;劳动关系［中图分类号］F840．686［文献标识码］A［文章编号］1673－1360(2023)01－0092－05［Abstract］Employer＇sliabilityinsuranceisakindofliabilityinsuranceusedbyemployerstotransfertheemploymentrisksofenterprises，maintainandprotectthenormalbusinessactivitiesofenterprises．Byanalyzingthecommoncontroversialpointsinthetrialofemployer＇sliabilityinsurancecases，theprincipleoflosscompen-sationofthepropertyinsuranceshallalwaysbeadheredtointhetrialinthisessay．Theactuallossesofthein-suredshallbefullycompensatedinordertobalancethelegitimateinterestsofinsurersandinsuredandachievetheoriginaldesignintentionofinsuranceproductstodisperserisks．Meanwhileinordertopreventtheinsuredfromcapturingexcessiveincomeandreducetheoccurrenceofdisputesfromthesource，insurancecompaniesshalloptimizethemanagementsystemandtheclause，andemployersshallenhancetheirlegalawarenessandva-riousregulatorsshallstrengthenjointeffortstocollaboratetoresolvedisputes．［Keywords］employer＇sliabilityinsurance;exceptionclause;employmentinjuryinsurance;laborrela-tionship近年来，随着中小企业的蓬勃发展以及企业用工风险意识的增强，雇主责任保险的投保量不断增长，与之而来的是越来越多的企业诉讼保险公司拒赔案件。雇主责任保险司法案件中存在诸多争议点，如劳动关系认定、实际赔付认定、与工伤保险竞合问题等，其中部分争议点目前尚未有定论，甚至形成多种截然相反的观...
