摘要我国婚姻法规定了夫妻之间应当互相忠实，互相尊重；家庭成员间应当敬老爱幼，互相帮助，维护平等、和睦、文明的婚姻家庭关系。而婚姻法司法解释规定当事人仅以婚姻法第四条为依据提起诉讼的，人民法院不予受理。司法实践中法官审理夫妻忠实协议案件没有法律依据，由此可见我国婚姻法中的夫妻忠实义务条款在司法实践中缺乏具体的操作性，因此越来越多的夫妻选择订立夫妻忠实协议的方式来确保彼此的忠诚，维持婚姻稳定。随着因订立夫妻忠实协议引发的纠纷越来越多，然而我国对于夫妻忠实协议的效力并没有明确的规定，因此造成很多同案不同判的现象。学术界对于夫妻忠实协议的效力也没有统一的定论。笔者认为应当认定夫妻忠实协议是有效的，本文主要包括我国关于夫妻忠实协议效力的司法实践，夫妻忠实协议的效力分析，夫妻忠实协议的立法建议三个方面，本文将通过文献分析和比拟分析的方法对夫妻忠实协议的有效性展开论述。关键词：效力；夫妻忠实协议；忠实义务AbstractTheMarriageLawofourcountrystipulatesthathusbandandwifeshouldbefaithfultoeachotherandrespecteachother,andfamilymembersshouldrespecttheelderlyandlovethechildren,helpeachother,safeguardtheequal,harmoniousandcivilizedmarriageandfamilyrelationship.IfthejudicialinterpretationoftheMarriageLawstipulatesthatthelitigantsonlytakeArticle4oftheMarriageLawasthebasisforlitigation,thepeople'sCourtshallnotacceptit.Inthejudicialpractice,thereisnolegalbasisforthejudgetotrythecasesofthefaithfulagreementbetweenhusbandandwife,soitcanbeseenthattheprovisionsofthefaithfulobligationofhusbandandwifeintheMarriageLawofourcountryarelackofspecificoperationinthejudicialpractice.Asaresult,moreandmorecoupleschoosetomakeloyaltyagreementstoensuretheirloyaltyandmaintainmarriagestability.WiththecauseTherearemoreandmoredisputescausedbytheagreementofhusbandandwifeloyalty.However,thereisnoclearstipulationonthevalidityoftheagreementofloyaltybetweenhusbandandwifeinourcountry,whichresultsinmanydifferentjudgmentsinthesamecase.Thereisnouniformconclusionaboutthevalidityoftheagreementofhusbandandwifeloyaltyinacademiccircles.Theauthorthinksthattheagreementofhusbandandwifeloyaltyiseffective.Thispapermainlyincludesthej...
